TERMS & CONDITIONS

 

Please read this information carefully. Once you make your payment to join the This Mummy Sews - Members Clubs the following terms and conditions apply. 

 

1. MEMBERSHIP DESCRIPTION

This Mummy Sews - MEMBERS CLUB

 

The cost of the Membership is set out in the sales page which can be found here:

Which shall include the following:

  • A private member only Facebook group which acts as the hub of our membership community and where most of the communication will take place regarding online lessons, zoom links and forms to tailor your sewing kit each month.

  • A monthly LIVE online zoom sewing lesson where you will learn how to sew new items, different fabrics, new skills and techniques. No month will ever be the same and the projects will be themed around the seasons too.

  • A monthly sewing kit that will be delivered to your door to be used to complete the online lesson.

  • Free online sew-cials every Tuesday night OR half price in-person sew-cials every Tuesday night at This Mummy Sews HQ (based in Wigan, North West UK)

  • A weekly facebook LIVE Q and A session where you can ask me any questions you need support with and I'll answer those during the live session.

  • You will have access to a library of pre-recorded lessons that you can access at any point. There will be sewing kits available to purchase (at an additional cost) that go alongside each lesson recorded too should you need them.

  • Links to all patterns used throughout the membership will be shared with you so that you can purchase the ones you absolutely love so that you can make different sizes in the future.

  • Exclusive discount codes from reputable fabric/haberdashery retail business once they have been onboarded.

  • Access to all new This Mummy Sews fabrics before anyone else and the option to purchase additional fabrics to go alongside your sewing kits each month if desired.

 

2. OUR RESPONSIBILITIES

As your sewing tutor and the leader of the membership, it is my responsibility to:

• Ensure the membership meets the quality standards agreed.

• Be on time and prepared for each session.
• Answer any questions you may have as they arise

• Comply with the terms of this Agreement.

As the Client, it is your responsibility to:
• Try, where possible to attend the LIVE classes where possible to get the most out of the membership.
•  Comply with the terms of this Agreement and promptly provide payment.
• Ask any questions you may have so that I can help build your skills and knowledge faster.
• Not to share any This Mummy Sews PDF patterns with other people not inside the membership. If people want access to my patterns they need to purchase them or join the membership. Patterns from other pattern designers will have similar terms and condition in place, just to make you aware.

• Maintain your own machine and read your instruction manual carefully and ensure your machine is in good working order before the LIVE classes. Although I can solve most technical problems when sewing, I may not have time during lessons to give 1-2-1 help and support. I recommend having your machine serviced on a regular basis.

 

 

Contacting Debbie, the membership Leader:
The primary method of contact is via the private membership facebook group. Usual office hours apply 9am-5pm Monday - Friday. If you ask questions after these times or during the weekend I won’t always be able to get back to you straight away as I have a young family and work the membership around them.

3. PAYMENT

Payment for the Membership is on a rolling subscription basis and your payments will continue every month until you choose to cancel.

We accept payment via credit or debit card via our website.

Your credit card or debit card will only be charged when you authorise the payments by clicking proceed through our website.

All payments by credit card or debit card need to be authorised by the relevant card issuer.

If your payment is not received by us you will be notified by email that your payment has failed where you will be prompted to rectify, usually by updating your card details. If you payment fails your access to the membership portal will be frozen until your payment is received and the subscription is active.

Nothing in this clause affects your statutory cancellations rights so far as they apply.

The price of the services is in pounds sterling (£) (GBP) 

 

4. CONFIDENTIALITY

Your privacy and personal information are important to us. Any personal information that you provide will never be shared with any third parties. Your details will be used strictly for communication purposes for as long as you are part of the membership.

 

5. INTELLECTUAL PROPERTY RIGHTS

We retain all ownership rights to the materials provided to you through your participation in the Membership. We reserve all rights, title and ownership of all materials which are provided to you for your individual use only and with a single-user licence.

We do not authorise you to share, copy, distribute, or disseminate any materials received electronically or otherwise without our prior written consent. All intellectual property, including the Membership materials, lesson help sheet, recordings or any other content shall remain our property and you will not obtain any rights of ownership or other rights (of whatever nature) in the digital or other content or in any copies of it.

 

6. DISCLAIMER

To get the most out of this membership you are responsible to ensure your machine is in good working order. This Mummy Sews holds no responsibility If you are unable to complete sewing projects due to faulty machinery. 

Any items created by you during the lessons and as part of the membership are for your own personal enjoyment and for your child to wear. Please take note of care instructions provided for the fabrics used within the sewing kits provided.

Please adhere to safe sleep policies which can be found on the NHS website when dressing your baby in clothing you have created. No items will be made on the membership with tie cords or any other items that may cause harm to your baby/child. It is your responsibility to check that buttons and kam snaps used as fastening (and any other haberdashery items, decorative items included)  on the clothing you create are secure and safe. Please ensure that all accessories are removed when your baby is sleeping including headbands, head wraps, knot bands, hats  and bibs.

 

7. TERMINATION

If you wish to cancel you need to contact us via email at info@thismummysews.com at least 48 hours before your payment is due. Cancelling after this time may result in a further payment being made.

Your subscription will be cancelled at the end of your current billing period; no refunds will be made.

We may terminate your access to the Membership, with immediate effect, if you:

(a) commit a material breach of your obligations under this Agreement; or

(b) fail to provide payment of any amount due as and when it becomes due; or

(c) any of the circumstances arise as set out in these terms.

We shall also be entitled to limit or suspend, and/or terminate the arrangement without refund whether paid or remaining due and payable, if we reasonably determine that you:

a) are becoming disengaged, disruptive or if you impair the provision or the enjoyment of the Membership for any other participant. 

 

 8. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between us. This Agreement may be modified or amended at any time if the amendment is made in writing and is signed by both of us. You may not assign your rights or obligations under this Agreement to anyone else. In the event that any part of this Agreement is deemed invalid or unenforceable, it shall not affect the validity or enforceability of any of the remaining portions of the Agreement which shall be severed and remain in full force. The failure to enforce any provision of this Agreement shall not be construed as a waiver or limitation of the right to later enforce and compel strict compliance with every part of this Agreement.

 

9. DISPUTES

We will try to resolve any disputes with you quickly and efficiently.

If you are unhappy with:
• the services;
• our service to you generally; or
• any other matter,

please contact us as soon as possible at info@thismummysews.com where we will aim to respond to your expression of dissatisfaction within 48 hours.

If you and we cannot resolve a dispute using our internal complaint handling procedure, we will:

• let you know that we cannot settle the dispute with you; and

• give you certain information required by law about our alternative dispute resolution provider.

If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract.

The laws of England and Wales will apply to this contract.

 

10. MISCELLANEOUS

By completing your purchase, you are accepting the terms of this Agreement, you are agreeing to be legally bound by its terms, and acknowledge that you have read, understood and agreed Your Membership will not begin until acceptance of this document has been received, and payment has been made.
